It's a subtle distinction, but I do happen to think it's a meaningful one. Get a witness who says she told the guy that he could kill someone, and he replied "what do I give a censored ?" and you have a completely different case. That's sociopathic behavior, whereas someone could (presumably) make the decision to get behind the wheel without feeling that way. Not that a second offender deserves a lot of leniency (like I said, I think 15-20 would suit this guy just fine), but in a prison population filled with violent and non-violent offenders, a standard DUI moron would fall squarely in the latter camp.
